These Terms of Service, together with our Privacy Policy, govern your use of our website(s), e-commerce site(s), and app(s) (individually and collectively, the "site"). By visiting our site and/or making a purchase through our site, you agree to be bound by these terms and conditions ("Terms of Service" or "Terms"), and you represent that you are at least the legal purchase age for alcoholic beverages in your state or province. If you do not agree to these Terms, you may not access the site or use any of our services. These Terms are subject to change.

1. Account Creation and Registration
   In order to use some of the features of the site, including, but not limited to, making online purchases, you may have to register for an account. This may include providing details such as your name, phone number, date of birth, address, and email address, and choosing a password. You agree not to create an account or use the Services if you have been previously banned from use of the Services.
   
   Our store's site is powered by City Hive Inc. Your data is stored with City Hive Inc. and may be used to log in to other City Hive powered retailers. If you have an active account with another City Hive powered retailer, you may use the same login credentials.
   
   SSO and Guest Checkout: You may use Social Sign-On ("SSO") through Facebook or another social media platform in order to create and access your account. This involves sharing your social media account information with us. We may offer, at our discretion, guest checkout. In order to use guest checkout, you will need to agree to the Google Pay, Apple Pay, or other applicable Terms of Service.
   
   

2. Account Ownership
   You are responsible for maintaining the confidentiality and security of your account. You may not allow others to use your account, you are responsible for any unauthorized use of your account, and you must notify us through our e-commerce provider at info@cityhive.net if your account has been breached or used by anyone else.
   
   You are responsible for maintaining the confidentiality and security of your account and password, and you are fully responsible for all activities that occur under your password or account, and for any other actions taken in connection with the account or password. You agree to (a) immediately notify us of any known or suspected unauthorized use(s) of your password or account, or any known or suspected breach of security, including loss, theft, or unauthorized disclosure of your password or credit card information; and (b) ensure that you exit from your account at the end of each session. We will not be liable for any injury, loss, or damage of any kind arising from or relating to your failure to comply with (a) and (b) or for any acts or omissions by you or someone else using your account and/or password.
   
   

3. Age and Identity, Right to Refuse Service
   By accessing the site, you confirm that you are at least the legal purchase age for alcoholic beverages in your jurisdiction. You may be required to show proof of your age and identity at the point of purchase, order pick-up, or order delivery. We reserve the right to cancel your order, to refuse to fulfill an order, to close your account, and/or to refuse service to anyone for any reason at any time, including but not limited to suspected intoxication or suspected use of fraudulent identification.
   
   

4. Age-Restricted Products; California Regulatory Compliance. You agree that your use of the Services, and the purchase, delivery, receipt, possession, and/or use of any alcohol, tobacco, nicotine, tobacco-related, CBD, or other age-restricted products made available through the Apps or the Sites (“Age-Restricted Products”), will comply with all applicable local, state, and federal laws and regulations, including without limitation the California Business and Professions Code, the California Alcoholic Beverage Control Act, the California Stop Tobacco Access to Kids Enforcement (STAKE) Act, and any regulations promulgated thereunder (collectively, the “Laws”). You further certify that the intended use of any Age-Restricted Products will not constitute drug paraphernalia or otherwise violate 21 U.S.C. § 863 (P.L. 113-31). Gopuff does not promote or condone the use of marijuana or any other controlled substance as defined under applicable federal or California law. All Age-Restricted Products are intended solely for lawful, personal use and not for resale, and nothing on the Sites or Apps shall be construed as encouraging or promoting the use of any illegal or controlled substance. By purchasing Age-Restricted Products through the Sites or Apps, you represent and warrant that the individual receiving an order containing Age-Restricted Products is at least twenty-one (21) years of age, as required under California law, and will present valid, government-issued photo identification upon delivery for age verification. Gopuff and/or its employees, agents, contractors, or designated common carriers reserve the right, in their sole discretion, to refuse delivery if acceptable identification is not presented, if the recipient appears intoxicated, or if delivery would otherwise violate applicable Laws. You agree that you will not furnish, sell, give, or otherwise provide any Age-Restricted Products obtained through the Services to any person who is under the lawful age or otherwise prohibited from receiving such products under California or federal law. You further acknowledge that furnishing alcohol or other Age-Restricted Products to a minor may result in civil and criminal penalties under California law.

5. Pricing and Availability
   We reserve the right to change pricing at any time without notice. The prices on our site may differ from the prices in our retail store(s).
   
   We reserve the right, but are not obligated, to limit the sales of our products or services to any person, geographic region or jurisdiction at any time, in our sole discretion. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at any time without notice, in our sole discretion. We reserve the right to discontinue any product at any time. Any offer for any product or service made on or through our site is void where prohibited.
   

6. Ordering and Payments

The site is intended for personal, non-commercial use only. Our products are not intended for resale or for wholesale distribution. Collection or "scraping" of our product listings, images, descriptions, pricing information, and/or other downloading or copying of site data, or any other data collection from our site, is prohibited and is a violation of these Terms.
    
    You may not modify, copy, distribute, re-publish, transmit, display, perform, reproduce, publish, reuse, resell, license, create derivative works from, transfer, or sell any information, content, material, software, products or services obtained from the site, whether done manually or through the use of any technological tool.

    Our site is powered by City Hive Inc. In all instances, all sales are advertised, accepted, made, and delivered by the licensed retailer. You acknowledge and agree that City Hive and/or its licensors own all right, title and interest in and to the services and their content (including without limitation any and all patent, copyright, trade secret, trademark, show-how, know-how and any and all other intellectual property rights therein or related thereto) and you agree not to take any action(s) inconsistent with such ownership interests.     If any provision, or portion thereof, of these Terms is held by a court of competent jurisdiction to be invalid, illegal, void, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent, and the remaining provisions of these Terms will continue in full force and effect.
